A pre/postnuptial agreement will normally entail a list of all the assets owned by each party, specifying what will happen to them in the event of a divorce or end to a civil partnership.

What is a pre-nuptial agreement?

A pre-nuptial agreement, also known as a premarital agreement, is a written agreement made by a couple who intend to marry or enter into a civil partnership concerning the ownership of their respective assets should the marriage fail or civil partnership end.

What is a Postnuptial agreement?

A Post-nuptial agreement, also known as an interspousal agreement, commences during a marriage, it is similar to a prenuptial agreement but the one factor that differs a postnuptial agreement from a prenuptial agreement is that a postnup is entered into after a party is married.

Civil Partnership dissolutions

When the Civil Partnership Act 2004 was introduced (CPA 2004), it related to two persons of the same sex. However, in December 2019 there was a change in the law which then allowed opposite-sex couples to register for a civil partnership in England and Wales. The marriage and civil Partnership act 2022 has also been enforced on 27th February 2023 increasing the minimum age for a civil partnership to 18, as opposed to 16.

Civil Partnerships have the same legal status as married couples, conversely, civil partnerships may only be ended on death, by final dissolution or nullity order.
