Grants of letters of administration would come into place if the deceased died without a will and the person who is entitled to inherit under the Rules of Intestacy will be the one who need to apply.
What are the Rules of Intestacy?
The order of priority on Intestacy are set out in section 46 of the Administration of Estates Act 1925 (AEA 1925) but if you are a surviving spouse of the deceased the rules significantly changed following the Inheritance and Trustees’ Powers Act 2014(ITPA 2014).
